BANIDNG LEVEL

LEVEL PROCEDURES  STEPS TO BE APPLICABLE TO APPLICANT 

Submit a lawsuit in writing or verbally to the Religious Court / Syari’ah Court within a period of time;

14 (fourteen) days starting from the following day from the day of the announcement of the decision announcement / notification of the decision to the parties concerned;30 (thirty) days for the Applicant who is not residing in the residence in the jurisdiction of the Religious Court / Syari’ah Court which decides the first level case (Article 7 of Law No. 20 of 1974}.

Pay appeal fees (Article 7 of Law No. 20 of 1974 & Article 89 of Law No. 7 of 1989}. Registrar notices an appeal request (Article 7 of Law No. 20 of 1974}.

The appellant may file a memorandum of appeal and the Respondent may submit a counter memory appeal (Article 11 paragraph (3) of Law No. 20 of 1974}.Not later than 14 (fourteen) days after the request has been notified to the opposing party, the clerk provides the opportunity for both parties to view the case file at the office of the Religious Court / Syari’ah Court (Article 11 paragraph (1) of Law No . 20 of 1974}.

The appeal case file was sent to the High Religion Court / Provincial Syari’ah Court by the Religious Court / Syari’ah Court which examined the case at the first level to be submitted to the parties.

A copy of the appeal decision is sent by the High Religion Court / Provincial Syari’ah Court to the Religious Court / Shari’ah Court which examines the case at the first level to be submitted to the parties. The Religious Court / Shariah

Court submits a copy of the decision to the parties.after the decision has permanent legal force, the clerk:For divorce talak cases: Notify about the Determination of the Day of Session of pledge of pledge by calling the Applicant and the Respondent; Giving Divorce Deed as proof of divorce no later than 7 (seven) days. For case of divorce:Giving Divorce Deed as proof of divorce no later than 7 (seven) days.

PROCESSING SETTING PROCESS

Appeal case files are recorded and given a register number;The Chairperson of the High Religion Court / Provincial Syari’ah Court makes the Determination of the Panel of Judges who will examine the file;

The Registrar determines the Substitute Registrar who will assist the assembly;Substitute Registrars submit files to the chairperson of the assembly;Substitute Registrar distributes case files to the High Judge Assembly;

The High Judge Council decides the appeal case;Copies of decisions are sent to both parties through the First Level Court.
